Blue Sky Swings warrants to the original purchaser at the original installation address, a Limited 20 Year Warranty that covers defects in workmanship and materials that affect the structural integrity of the playground systems, such as the PVC plastic lumber and wood components. In addition slides, metal components, swings and accessories are covered by a Limited 5 Year Warranty from date of original purchase. Normal wear such as minor surface rust, corrosion, or chipped powder coating on metal parts that does not affect the structural integrity of the product is not considered a defect in workmanship or material and is not covered by this warranty.

These Limited 20 Year and Limited 5 Year warranties are limited to products used for residential, single family dwellings. Play sets installed in a non-residential or multi-use family setting are covered by a Limited 10 Year Warranty.

The manufacturer's products are not warranted as being suitable for a particular purpose. The suitability of the product is for the purchaser to determine. This warranty does not cover normal wear and tear, damage due to improper installation, damage caused by failure to properly maintain the product, or damage resulting from misuse or abuse of the product. It does not cover damage caused by things that are beyond our control such as normal and expected weathering of the surface, chalking, mold or mildew, exposure to harmful chemicals of metal oxides, acid rain and surface discoloration due to atmospheric pollution (including but not limited to the vapors of acid rain). Additionally damage caused by acts of nature such as lightning, storms, hurricanes, tornados, earthquakes or any extreme weather conditions are not covered under this warranty. Any alteration, addition or relocation of the product will void this warranty.

Blue Sky Swings reserves the right to examine photographs and/or physical evidence of the product claimed to be defective, and to recover product prior to any warranty claims. All products returned for inspection must be sent freight prepaid. In the event of a defect covered by these warranties, Blue Sky Swings will remedy the defect within a reasonable time. The remedy will consist of repair or replacement of the defective piece unless it is not practical. Then Blue Sky Swings will reimburse the original purchaser for the value of the defective piece.

Blue Sky Swings shall not be liable under any circumstance for any special, indirect, incidental, consequential, or punitive, damages including but not limited to loss of profits, loss of business opportunities, or loss of goodwill, for failure to perform its obligations under this agreement. Additionally, special, indirect, incidental, consequential, and punitive damages shall not be recoverable even if the repair, replacement, or refund remedy fails of its essential purpose or for any other reason. Blue Sky Swings' aggregate liability under any legal theory will be limited to the purchase price paid by a customer for a defective product.
